Join us for an attorney's and a financial professional’s view of navigating guardianship, estate planning, trusts, wills and probates in the context of planning for end-of-life transfer of assets for clients and their families. Potential diminishment is an important element for advancement professionals, attorneys and financial advisors to recognize and address as they help facilitate planned giving plans for donors. In this session our presenters will define “diminishment” and that incapacity may not rise to the level of incompetency. The speakers will relate real life scenarios exploring what to do when the individual doesn’t recognize they may have diminished capacity, when issues arise with Powers of Attorney, where the POA conflicts with the named revocable living trust trustee, temporary POAs, more restrictive tools like guardianships, and more.

Chad Proctor is a senior fiduciary specialist wealth manager for BNY Mellon Wealth Management. In his role, he works directly with clients to address their investment and wealth management needs.
Chad joined the firm in 2019 and has more than 15 years of experience in the financial services industry. His previous experience includes serving as a fiduciary specialist for Northern Trust, trust advisor for Comerica Bank & Trust and estate officer for Wells Fargo Private Bank.
Chad received a bachelor's degree from The University of North Carolina at Chapel Hill, JD from Saint Thomas University and LLM in Tax from The University of Washington. He is a member of the Seattle Estate Planning Council.
Jonete Waters Rehmke, JD

Jonete Waters Rehmke is an attorney licensed in Washington State whose practice focuses on the area of Elder Law. Ms. Rehmke practiced as a litigation paralegal for 14 years and then after earning her law degree she gained admittance to the Washington State Bar in 1999. Since then, she has been handling Elder Law cases with compassion and an understanding that her clients need during difficult times. She is a fierce advocate for the elderly in and out of the courtroom, assisting with matters ranging from guardianship and estate planning to probate and Medicaid issues.
As an undergraduate, Ms. Rehmke attended Washington State University where she studied Anthropology and History and later earned her BA in Communications from the University of Washington. She went on to earn her Juris Doctor (Cum Laude) from Seattle University School of Law and has stayed in the local area where she has built her practice and raised her family. Ms. Rehmke is currently a member of the Washington State Bar Association, Tacoma Pierce County Bar Associations, Tacoma Estate Planning Council, Health Care Providers Council of Pierce County and the National Academy of Elder Law Attorneys.
